Barnett is Found Liable of Assault and Emotional Damages: Ordered to Pay Close to $75,000: The decision is a step in the right direction in stopping vigilante violence but feels much more is needed to promote greater accountability and oversight within the border region.

Border Action Members at the Barnett TrialAfter two weeks of testimony and evidence heard in the DeConcini Federal Courthouse in Tucson, Roger Barnett-a renowned border vigilante, was found guilty of assault and intentionally causing emotional harm on 6 men and women originally from Mexico stemming from their encounter with Barnett on March 7, 2004. After discovering a group of 16 men and women that he alleged to be on his property, Barnett threatened the unarmed group at gunpoint, kicked a young woman twice, and detained them for close to 30 minutes until Border Patrol arrived.

The trial began on February 2nd and included testimony from each of the 6 plaintiffs, and from other people who have had encounters with an enraged Barnett including, a Cochise County Sheriffs' deputy, a bow hunter who had racial insults hurled at him by Barnett, and a Douglas EMT who recalled how Barnett falsely flagged down his ambulance so that he could see if the person inside was who he had been tracking. The civil suit, which was presented by the Mexican American Legal Defense and Educational Fund (MALDEF), originally named Barbara Barnett and Donald Barnett as co-conspirators, who were dismissed of their charges by Judge Roll who felt there was a lack of evidence proving these charges. Furthermore, since only 6 of the 16 plaintiffs were present in order to testify, the other 10 plaintiffs were excluded from the suit as well.

Stayed Tuned for this Year's Arizona State Legislative Alerts!

Border Action Network will once again launch their State Legislative Campaign, aimed at monitoring anti-immigrant bills throughout the session, following our successful 2008 session. With your support, phone calls, and emails, we watched as 44 anti-immigrant bills were halted to the ground. While we have yet to see any anti-immigrant bills to be filed within legislature's first week back to work, we anticipate yet another busy session.

Stay tuned! We will be distributing Action Alerts to our members and supporters that include a series of talking points that reflect why these bills are bad/good for the entire state of Arizona, which includes immigrant families. Immigrant families in Arizona want the same thing that other families want -a life with dignity, safety, security, good education, quality health care, clean environment, etc. Our message attempts to break the stereotype of anti-immigrant vs. pro-immigrant. Our legislators need to see and hear that. So PLEASE take the time to contact these committees as bills come up. It CAN and WILL make a difference. If you can attend a committee meeting, please do! Contact our office at 520-623-4944 if you want help registering to speak.
