SB1280 makes it a class 5 felony to knowingly or recklessly conceal, harbor or shield from detection or attempt to conceal, harbor or shield from detection in any place—i.e., building or means of transportation, any person who is not lawfully in this state. This bill is vague and overreaching, in that anyone—from landlords who unknowingly rent to undocumented persons, an employee who offers a coworker a ride home, or a U.S. citizen husband with a wife who is undocumented could be portrayed as “attempting to harbor and conceal undocumented persons” and charged with a felony.
