May 21, 2013 Subject: Dear Senator, SB1175 takes away the responsibility of the heads of local law enforcement agencies and Boards of Supervisors to create policy, and oversee and approve laws and policies that govern their counties. The bill is also an unconstitutional attempt to preempt the Supremacy Clause of the U.S. Constitution by granting local law enforcement the ability to charge a person unlawfully present with criminal trespass! Arizona should not proceed down a path that blatantly disregards the Supreme Law of the land and the expertise of local heads of government, but instead gets us on a path towards putting our teachers back into their classrooms, our kids outside enjoying our state parks, and making a name for ourselves as being innovative rather than backwards.
