Tell the U.S. government to protect all prisoners from rape

Sexual violence is pervasive in America’s prisons and jails. An estimated 88,500 inmates reported at least one incident of sexual victimization by another inmate or facility staff in 2008 and 2009. Congress took an important step toward preventing sexual abuse in prison in 2003 when it passed the Prison Rape Elimination Act (PREA). But the Obama administration refuses to apply these protections to the 400,000 immigrants, refugees, and asylum seekers it detains every year.

When U.S. Attorney General Eric Holder announced proposed regulations for PREA, he exempted detention centers, prisons, and county jails that contract with the Department of Homeland Security (DHS) to hold immigrants.

The U.S. government has an obligation to protect the human rights of all people in its custody. Attorney General Holder's decision to exclude detained immigrants from receiving the same protections under PREA as any other person incarcerated in the United States is arbitrary and violates basic American principles of equal protection.
